Motion approved by the Council of the Municipality XVII Rome on 4 May last, concerning the reimbursement of VAT wrongly perceived by the MAI.

Subject: Return VAT evaded dall’AMA S.p.a. 


Considerato che:

- con D.L.vo n. 22/1997 è stata istituita la tariffa per la gestione dei rifiuti urbani;

- con Deliberazione C.C. n. 24/2003, il Comune di Roma ha adottato il Regolamento per l’applicazione, a decorrere dall’1 gennaio 2003, della nuova tariffa in sostituzione della vecchia TARSU;

- la Corte Costituzionale, con sentenza n. 238 del 24 luglio 2009, ha stabilito che la TIA (Tariffa di Igiene Ambientale)/Tariffa Rifiuti (TARI) riveste natura giuridica di “tassa” e non di “tariffa”;

- l’applicazione    dell’IVA al 10% sulla tassa di smaltimento rifiuti risulta pertanto illegittima e non
deve essere quindi più applicata per il futuro;

- nonostante ciò,  AMA S.p.A.     ha continuato ad applicare l’IVA sulla tariffa rifiuti anche dopo la
 pubblicazione della citata sentenza e  ne    ha richiesto il pagamento con la seconda rata semestrale del 2009;

- l’efficacia retroattiva della sentenza della Corte Costituzionale also involves the unlawful

the President and the Board of the Town Hall to take action against the Board for the City of Rome and of the AMA that is respected the ruling of the Constitutional Court No 238, 24 July 2009 and returned to Roman citizens are the sums overpaid by AMA as VAT on that fee, including the possibility of clearing as well as such sums due in respect of waste charges for the current year .

The President, assisted by Councillors John and Zizza, which act as scrutineers, put to vote, by show of hands, extended on the proposed motion, which was unanimously approved by 14 votes e 6 voti di astensione (Consiglieri Gemmellaro, D’Alessandro, Servilio, Aubert, De Benedictis, Avveduto).
