Subject: Return VAT evaded dall’AMA S.p.a. 


Considerato che:

- con D.L.vo n. 22/1997 è stata istituita la tariffa per la gestione dei rifiuti urbani;

- con Deliberazione C.C. n. 24/2003, il Comune di Roma ha adottato il Regolamento per l’applicazione, a decorrere dall’1 gennaio 2003, della nuova tariffa in sostituzione della vecchia TARSU;

- la Corte Costituzionale, con sentenza n. 238 del 24 luglio 2009, ha stabilito che la TIA (Tariffa di Igiene Ambientale)/Tariffa Rifiuti (TARI) riveste natura giuridica di “tassa” e non di “tariffa”;

- l’applicazione    dell’IVA al 10% sulla tassa di smaltimento rifiuti risulta pertanto illegittima e non
deve essere quindi più applicata per il futuro;

- nonostante ciò,  AMA S.p.A.     ha continuato ad applicare l’IVA sulla tariffa rifiuti anche dopo la
 pubblicazione della citata sentenza e  ne    ha richiesto il pagamento con la seconda rata semestrale del 2009;

- l’efficacia retroattiva della sentenza della Corte Costituzionale also involves the unlawful
